Decision No. 879/QD-BKHDT dated May 15th, 2023 by the Minister of Planning and Investment.

Article 1. Position and functions

The Agency for Cooperative Development is an affiliated unit under the Ministry of Planning and Investment, which helps the Minister perform the state management function on collective economy and cooperative economic development.

Agency for Cooperative Development has its own legal status, seal and level 2 account; its operational funding is provided by the state budget and compiled in the annual estimate of the Ministry of Planning and Investment.

Article 2. Tasks and powers

1. Presiding over or participating in drafting legal documents on collective economy and cooperative economy; mechanisms, policies, and solutions to support the development of collective and cooperative economies; organizing propaganda, dissemination, and guidance on implementation of legal regulations on collective economy and cooperative economy; providing guidance on handling problems and difficulties in organization and operations under the Ministry's authority for collective economic and cooperative economic organizations.

2. Presiding over guiding, synthesizing, and building strategies, plans, programs, and projects for developing the collective economy and cooperative economy of the whole country; reviewing and synthesizing state budget allocation plans to support the development of collective economy and cooperative economy for ministries, central agencies, localities, the Vietnam Cooperative Alliance and socio-political organizations, unions and associations.

3. Presiding over the organization of inspection, urging and summary assessment of the implementation of legal documents, mechanisms, policies, strategies, plans, programs, projects for collective economic and cooperative economic development that have been issued or approved by competent authorities under the management of the Ministry of Planning and Investment; uniformly stipulating the report and inspection, monitoring and summarization of the development situation of cooperative economic organizations.

4. Presiding over and coordinating with relevant units to guide, train and foster professional expertise in the field of collective economy and cooperative economy.

5. Presiding over the construction, exploitation and use of information portals and national databases on collective economy and cooperative economy; providing information to serve the research and development of laws, strategies, plans, programs, schemes, mechanisms and policies to support the development of collective economy and cooperative economy; coordinating with relevant units to process and provide information in assigned fields.

6. Carrying out international cooperation on collective economic and cooperative economic development. Presiding over or participating in building, guiding, implementing, inspecting, monitoring, evaluating and summarizing the implementation of programs and projects supported by countries and international organizations to develop collective economy and cooperative economy.

7. Organizing in developing model, piloting, deploying, summarizing and disseminating and replicating advanced examples in cooperative economic organizations; issuing information publications on collective economy and cooperative economy nationwide.

8. Performing State management of public non-business services within the scope and fields under the responsibility of the Department.

9. Presiding over the implementation of management tasks for unions and associations whose main fields of operation fall under the state management function of the Department. Coordinating with units under the Ministry to perform relevant tasks within the scope of management of the sectors and fields in charge.

10. Presiding over guiding the implementation of legal regulations on investment and business for the fields under the responsibility of the Department. Presiding over and coordinating with relevant units to organize the codification and consolidation of legal documents in the fields under the responsibility of the Department according to regulations.

11. Managing the organizational structure, staffing, civil servants, public employees, workers and assigned assets and finances according to the provisions of law and decentralization of the Ministry.

12. Performing other tasks as assigned by the Minister.

Article 3. Organizational structure

Administrative units include:

1. General Affairs Division.

2.  Policy and International Cooperation Division.

3. Local Cooperative Economic Division.

4. Agency Office.

Civil servant staffing, number of employees and number of contract workers receiving salaries from the State budget of the Agency are decided by the Minister.

Article 4. Leadership of Agency for Cooperative Development

1. The Leadership of the Agency has one Director General and a number of Deputy Directors General.

2. The Director General and Deputy Directors General are appointed, dismissed and terminated by the Minister according to the provisions of law.

3. The Director General regulates the functions and tasks of administrative units under the Agency; develops working regulations and internal spending regulations of the Agency according to the provisions of law;

4. The Director General is responsible before the Minister for the organization and management of all activities of the Agency.

5. The Deputy Directors General are responsible before the Director General and the law for the assigned fields of work.

Article 5. Enforcement

This Decision has come into force since the date of signing and replaces the Decision No. 1879/QD-BKHDT dated December 22^nd, 2017 by the Minister of Planning and Investment on the functions, tasks, powers and organizational structure of Agency for Cooperatives Development.

Article 6. Implementation responsibility

Director General of Department of Organization and Personnel, Chief of the Ministry Office, General Director of Agency for Cooperative Development and the heads of units and organizations under the Ministry are responsible for implementing this Decision./.
