Decision No. 858/QD-BKHDT dated May 15th, 2023 by the Minister of Planning and Investment.

Article 1. Position and functions

Department of Science, Education, Natural Resources and Environment is an affiliated unit under the Ministry of Planning and Investment which helps the Minister perform the state management functions on planning and investment in developing sectors and fields of: science, technology and innovation; academic education and vocational education; basic investigation; resources and environment; climate change; green growth; sustainable development.

Article 2. Tasks and powers

1. Researching and synthesizing strategies, make planning for sectors and fields of: science, technology and innovation; academic education and vocational education; basic investigation; resources and environment; climate change; green growth; sustainable development.

2. Presiding over synthesizing 5-year and annual plans for developing sectors and fields of: science, technology and innovation; academic education and vocational education; basic investigation; resources and environment; climate change; green growth; sustainable development. Presiding over the synthesis of annual and medium-term public investment plans: list of projects using state budget capital and other public investment capital sources in the sectors and fields under the responsibility of the Department; Coordinating with relevant units to develop a list of priority programs and projects to attract foreign investment capital, ODA capital, preferential loans, and non-refundable aid that are not part of official development support; list of projects belonging to national target programs, public investment programs and other projects as assigned by the Ministry.

3. Researching and proposing mechanisms and policies to develop sectors and fields under the responsibility of the Department; Coordinating with relevant units in the Ministry to research and propose mechanisms and policies for socio-economic development in the 5-year and annual plans. Coordinating for the development and appraisal of mechanisms, policies and draft legal documents of the sectors and fields under the responsibility of the Department.

4. Monitoring the implementation of strategies, planning, plans, programs and projects (including ODA capital, concessional loans, non-refundable aid not part of official development assistance), periodic assessment reports according to regulations of sectors and fields under the responsibility of the Department. Proposing solutions to handle problems in the process of managing and implementing the plan. Researching, collecting and systematizing information for the development of strategies, planning and development plans for sectors and fields under the responsibility of the Department; Coordinating with relevant units in the Ministry to process and provide information about the sectors and fields under the responsibility of the Department.

5. Presiding over the appraisal of investment policies, capital sources and ability to balance capital of projects under the approval and decision on investment policies of the Prime Minister in the sectors and fields under the responsibility of the Department. Presiding over giving opinions on national planning prepared and adjusted by ministries and ministerial-level agencies mentioned in Clause 8, Article 2 of this Decision. Coordinating for the appraisal of national target programs, public investment programs, important national projects and other projects according to regulations. Monitoring, inspecting and evaluating the implementation of public investment plans.

6. Presiding over research and proposing domestic and foreign schemes, programs and projects in the sectors and fields under the responsibility of the Department. Presiding over the management of programs and projects assigned by the Ministry.

7. Presiding over and coordinate with ministries, localities and relevant agencies to implement the National Action Plan to implement the 2030 Agenda for sustainable development; National Strategy and Action Plan on Green Growth. Presiding over monitoring, evaluating and summarizing the results of implementing the Sustainable Development Goals and the National Action Plan to implement the 2030 Agenda; National Strategy and Action Plan on Green Growth. Developing an annual report on the implementation of the Sustainable Development Goals to submit to the Government and the National Assembly, and reporting on the results of the implementation of the National Green Growth Strategy annually to the Government. Organizing preliminary and final reviews of the implementation of the National Action Plan to implement the 2030 Agenda; National Strategy and National Action Plan on Green Growth. Presiding over the implementation of the tasks of the national focal point on green growth and the standing agency of the National Steering Committee on green growth. Presiding over the implementation of the National Designated Authority (NDA) mandate for the Green Climate Fund (GCF) and climate finance cooperation frameworks. Being the focal point for participating in tasks related to the United Nations Framework Convention on Climate Change (UNFCCC).

8. Presiding over synthesizing 5-year and annual plans of: Ministry of Science and Technology, Ministry of Education and Training, Ministry of Natural Resources and Environment, Vietnam Academy of Social Sciences, Vietnam Academy of Science and Technology, Hanoi National University, Ho Chi Minh City National University, Hoa Lac Hi-Tech Park Management Board, Vietnam Union of Science and Technology Associations.

9. Presiding over guiding the implementation of legal regulations on investment and business in the sectors and fields under the responsibility of the Department. Presiding over organizing the implementation of codification and consolidation of legal documents in the sectors and fields under the responsibility of the Department according to regulations.

10. Presiding over the development and synthesis of science, technology and innovation activity plans of the Ministry; serving as the standing member of the Ministry's Scientific Council; presiding over synthesizing science, technology and innovation information of the Ministry. Presiding and coordinating with relevant units to develop and synthesize environmental protection plans using the Ministry's environmental capital, synthesizing plans and lists of basic investigation projects.

11. Presiding over the implementation of international cooperation in the sectors and fields under the responsibility of the Department as assigned by the Ministry. Presiding over and coordinating for the implementation of the work of attracting, mobilizing and allocating resources for climate change, green growth, circular economy, sustainable development, and national determined contributions (NDC).

12. Performing other tasks as assigned by the Minister.

Article 3. Organizational structure

Department of Science, Education, Natural Resources and Environment has one Director General and a number of Deputy Directors General; The Department works under the Leader regime and Specialist regime; The Department’s staffing is decided by the Minister.

Article 4. Enforcement

This Decision has come into force since the date of signing and replaces the Decision No. 1872/QD-BKHDT dated December 22^nd, 2017 by the Minister of Planning and Investment.

Article 5. Implementation responsibility

Head of Department of Organization and Personnel, Chief of the Ministry Office, Head of Department of Science, Education, Natural Resources and Environment and the heads of units and organizations under the Ministry are responsible for implementing this Decision./.
